Terms of use

Last updated October 12, 2026.

These terms are the rules for using Secret Santa. They're written in plain language. By creating or joining an exchange you agree to them. If you don't agree, please don't use the site.

1. The service

Secret Santa helps a group run a gift exchange: an organizer sets it up, people sign up, names are drawn at random, and each person is emailed who they're buying for. The team behind the site operates the service and may improve, change or remove features at any time.

2. Who can use it

You need to be old enough to agree to these terms where you live. The service isn't directed at children under 13, and children shouldn't sign up on their own. If you organize an exchange that includes minors, you're responsible for having a parent or guardian's permission.

3. Organizers

If you create an exchange, you're responsible for it. You agree to:

4. Participants

You can join with a link, QR code or pass code you were given. Give a name and an email address that are yours. You may opt out any time before names are drawn. Once you've been matched, the exchange is a promise between you and a colleague, friend or family member, so please follow through.

5. Acceptable use

Please don't use the site to send spam, to run exchanges for unlawful purposes, to try to see anyone's match or private link, to interfere with how the site works, or to overload it with automated requests. We may remove an exchange or block access that breaks these terms.

6. Gifts happen between people

The site only organizes names and sends emails. We don't buy, deliver, inspect or guarantee any gift, and we aren't responsible for gifts that are late, missing, unsuitable or unwanted, or for disagreements between participants.

7. Your information

How we handle names, email addresses and matches is described in the privacy page, which is part of these terms. Organizers can delete an exchange at any time, which removes everything stored about it.

8. Availability

We work to keep the site running and to deliver every email, but we can't promise it will always be available or error-free, or that every email will arrive. Emails can be delayed, blocked or filtered by mail providers outside our control. Don't rely on the site for anything where a missed email would cause serious harm.

9. Limits of liability

The service is provided "as is". To the fullest extent the law allows, we aren't liable for indirect or consequential losses arising from your use of the site, and our total liability for any claim is limited to the amount you paid us for the service, which for most people is nothing. Nothing in these terms limits rights you have under the law that can't be limited.

10. Changes

We may update these terms. The date at the top shows when they last changed. If you keep using the site after a change, you accept the updated terms.

11. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
